《 Asset TOS/Rules 》

These rules apply to all assets: free, nitro, paid and commissioned assets..・Use for Personal / Commercial / Public [To Use on Free, please contact us directly for permission]・You MUST credit me correctly when using my assets. Using my full store name [Ma Machi Designs] and a link back to the asset or my store (at minimum). EG. "Asset Name" by MaMachi (https://mamachidesigns.gumroad.com/ or https://mamachidesigns.com)・You MUST not claim any of my assets or it's parts as your own. Provide credit for MY work.・You may ONLY use my assets on FINISHED MODELS, with proper credit to me. You may not modify, or use parts, of the asset to make your own asset for sale.・You CANNOT use my assets taken from another creator's model, you MUST buy it from my store to use it in ANY WAY.・Do NOT resell my assets in ANY WAY. This includes edited or modified.・Do NOT redistribute, leak or trade my assets in ANY WAY. This includes any 3rd party sites, forums, sharing websites, leaker sites, discord servers, sharing with friends etc.・Do NOT price-split my assets with ANYONE. Sharing them with anyone else is prohibited. Friends, partners, family's etc. Do NOT share them.・Paid assets ARE NOT ALLOWED on models that are less expensive than the highest priced asset from me. (eg, if the highest price asset (made by me) is purchased for $25, the model SHOULD NOT be less than $25).・Nitro assets CANNOT be used on free models or nitro models. They CAN be used on private models. You CANNOT use them on public or for-sale models UNTIL you have boosted my server for a FULL MONTH.・Your license to use the asset is ONLY VALID if you provide the correct information at checkout. Otherwise I have no proof of purchase and will issue a DMCA. You may also be blacklisted for breaking TOS.・DO NOT share codes for server exclusive assets, if you do: the code will be REMOVED and the assets may no longer be available.・DO NOT share discount codes for ANYTHING, if you do: the code will be REMOVED, your access will be removed, and action will be taken against you.・To purchase these assets for someone else, please use the gift function: https://customers.gumroad.com/before-you-buy/how-do-i-give-a-product-as-a-gift and fill THEIR discord and vrc username in at checkout!・My assets are non-refundable. ・Do NOT share/leak/trade or redistribute my model packages in ANY WAY. This includes any 3rd party sites, forums, sharing websites, leaker sites, discord servers, sharing with friends etc.・Do NOT resell my models or their assets in ANY WAY. This includes edited or modified in any way. They still remain under my ownership and copyright.・Do NOT use illegal versions of my models, please report those persons and do not use. You CANNOT use the model if you did not buy it yourself, or it was not gifted to you via my store. Sharing my models with anyone else is prohibited. If someone claims to have bought it for you, THEY MUST USE THE GIFT FUNCTION.・Do NOT price-split my models with ANYONE. Sharing them with anyone else is prohibited. Friends, partners, family's etc. Do NOT share them.・Do NOT claim my models as your own. Even edited/modified, they are my design, my creation. Provide credit where necessary; eg. Instagram/TikTok/Twitch etc.・Do NOT take any assets, animations, meshes, textures, etc. from my models. Any asset-mining is prohibited and you MUST obtain YOUR OWN license to these assets/textures/animations etc. Check Credits to know where to find them.・Do NOT set my models as PUBLIC on your account. Setting models for cloning or for World Pedestals is NOT ALLOWED.・Your Private license to use the model is ONLY valid if you provide the correct information requested at time of checkout. Please provide both your discord username and your vrchat username for my records. This information is not shared or used in any way, only as proof of purchase.・Commissioned models can be used for streaming IF you paid for COMMERCIAL USE RIGHTS. If you did not, then you may not use it as a Vtuber model/ Streamer model of any kind.・Do NOT upload the model onto anyone else's account. The purchase made is for 1 person only and if they do not have a valid license then they are subjected to a DMCA and then further legal actions.・Do NOT share the model with someone else for them to "upload" it for you. If you do this then you are giving them my model package which is against my TOS. Do not send the package or it's files to ANYONE else FOR ANY REASON.

Sharing them with anyone else is prohibited. Friends, partners, family's etc. Do NOT share them.・Paid assets ARE NOT ALLOWED on models that are less expensive than the highest priced asset from me. 《 Banned or revoked tos 》

These rules apply to all assets: free, nitro, paid and commissioned assets..・If you have been banned or blacklisted from our store or Discord, use of all avatars or assets for Personal / Commercial / Public / Free is completely revoked.・Any assets any member of Ma Machi helped create falls under the umbrella of our blacklist and is not allowed to be used by blacklisted/banned users. It may not be on our shop, but it is still our work. [Ie. Anything we rig, texture, make meshes for, etc.]
---> Example: Any asset by Seraphim that MaMachi/Foxmatcha has rigged or textured・You CANNOT use our assets in any way, especially if taken from another creator's model. This is called asset mining, and is another wayt to illegally gain access after being banned/blacklisted.・You CANNOT use any 3rd party sites, forums, sharing websites, leaker sites, discord servers, sharing with friends etc. to illegally gain access to assets/avatars after being banned/blacklisted.・You are NOT allowed price-split my assets/avatars with ANYONE to illegally gain access after being banned/blacklisted.

Terms of Service

《 Important info 》

・Base Price : $150
・Base Price includes: Commercial Use (For streaming) & Personal use for VRChat, Base Level Complexity, Two Outfits [plus full nude], Two Hairs, Base Unity work.
・ETA of Model completion is One month
・There is No refunds are all, unless I have to cancel the commission. Assets purchased will not be refunded.
・Additional toggles are $5 each.

《 Commission TOS/Rules 》

・I reserve the right to deny service to anyone
・I will not add DPS OR make a model NSFW if you are not 18+
・I require 50% payment upfront.
・You will need to provide the assets I do not own. You will have to gift them to me or provide the money to purchase them. I cannot work with assets I do not own commercial rights licenses for. Make sure you have all assets on hand or it'll be an additional $10 per asset that is not gifted for commercial use.
・Changes to assets on your model will not be applicable once I have started unity work. Once an avatar leaves Blender, I cannot not add more things as it breaks the hierarchy and messes up any already done Unity work.
・I will not lower my base price if you are requesting less than what is offered.
・You may not reshare / resell your commissioned model in any way. You have rights to use it, I still own the design.
・Although this model is custom for you, I still require credit for my work. When you upload your model, my discord# needs to be in the description.
・If you cancel this commission after it is started, I reserve the rights to resell it in my shop or to another buyer, and you will not receive a refund. All payments already made will be rendered equal to work already completed.
・All commission prices are final and non-refundable. If you change your mind after the assets have been purchased or work has begun, you forfeit the usage rights to the avatar.
・You must have the full cost of the avatar commission paid within 3 days of completion.
・If you wish to add to your commission or remake it after completion, you will be charged the cost of another commission.
・No leaking, ripping, price splitting, reselling, or uploading your avatar publicly.
・If any of these rules are broken, understand that legal action may be taken against you and your design will be mine to resell.

・If your model is ripped/leaked.
・If your model is posted publicly by someone other than you.
・If your model breaks in a future VRC update, I am not required to fix it.
・If you don't tell me the issues of your model before 48 hours, I won't fix the issues.
